As defined under the Residential Tenancies Act 1997 (Vic)
Under the Residential Tenancies Act 1997 (Vic), a rooming house is a building in which one or more rooms are available for rent, and the total number of people who may occupy those rooms is four or more.
This is the key legal threshold that distinguishes a rooming house from an ordinary rental property or a simple share house arrangement. Once four or more people can occupy the premises, the full rooming house regulatory framework applies — regardless of whether the building is a house, a converted dwelling, or purpose-built accommodation.
A rooming house is also distinct from other accommodation types such as residential parks, supported residential services, and crisis accommodation — each governed by separate legislation. If a property falls within the rooming house definition, both the operator and every resident have specific rights and obligations that cannot be contracted out of.
It is also important to note that a rooming house operator must be registered under the Act. Operating an unregistered rooming house is a breach of the legislation and can result in significant penalties.
